Motorsport Engineer (ME Education and Consulting, SL) maintains this website, the courses offered and other content such as blog posts and webinars (the “Site”) for the use of its customers, instructors, affiliates, students, and other Site users (“Users”) upon agreement to the following terms. Please read the terms carefully before using the Site. These Terms of Use (“Terms”) govern your use of our website, apps, and other products and services (“Services”). Please read these Terms carefully, and contact us if you have any questions, requests for information, or complaints. If you do not agree to these terms, do not use this Site. By using our Services, you agree to be bound by these Terms, including the policies referenced in these Terms.

1.Using the Motorsport Engineer Site
Motorsport Engineer provides various materials, information, quizzes, tests, questions, articles, news and other information in webinars, blog posts, and courses offered through this site (the “Materials”).

Subject to these Terms and Policies, Motorsport Engineer grants you a limited, personal, non-exclusive, non-transferable, and revocable license right to use our Services. The rights granted herein are only for your personal, non-commercial use. You also agree that you will create, access, and/or use only one user account, and you will not share access to your account or access information for your account with any third party. Using our Services does not give you ownership of or any intellectual property rights in our Services or the content you access. Users may not modify the Materials at this Site in any way or download, reproduce, share or distribute them. Users will keep all Materials confidential, and will not sell, auction, loan, rent, give away, describe, summarize, or otherwise reveal the Materials or their contents, to any other person or entity. Any breach of these Terms of Use automatically terminates your authorized use of the Site.

2. Who Can Use the Site
You may use our Site only if you:

  • can form a binding contract with Motorsport Engineer;
  • comply with these Terms, all applicable laws, and our policies; and
  • are over the age at which you can provide consent to data processing under the laws of your country.

Any violation of our Terms, applicable laws, or Policies may result in your access to all or part of the Site being disabled, or terminated.

When you create your Motorsport Engineer account, and when you subsequently use certain features, you must provide us with accurate and complete information, and you agree to update your information to keep it accurate and complete.

3. Updates to Content

Motorsport Engineer offers courses and content (“Materials”) from individuals and companies in the motorsport and automotive industries. While we strive to provide accurate, up-to-date and complete information, some information included in the courses may need to be updated or corrected from time to time. Motorsport Engineer reserves the right to modify content offerings at any time and without notifying Users. 

The Materials provided at this site are provided “as is” without any warranties of any kind including warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property. 

4. User Content
The Services enable you to share your content, such as homework, quizzes, exams, projects, other assignments you submit, posts you make in the forums, and the like (“User Content”), with Motorsport Engineer, instructors, and/or other users. You retain all intellectual property rights in, and are responsible for, the User Content you create and share. User Content does not include course content or other materials made available on or placed on to the Motorsport Engineer platform.

5. How Motorsport Engineer and Others May Use User Content
To the extent that you provide User Content, you grant Motorsport Engineer a fully transferable, royalty-free, perpetual, sublicensable, non-exclusive, worldwide license to copy, distribute, modify, create derivative works based on, publicly perform, publicly display, and otherwise use the User Content.

6. Limitation of Liability
In no event will Motorsport Engineer, its suppliers, or other third parties mentioned at this Site be liable for any damages whatsoever arising out of the use, inability to use, or the results of the use of this Site, any websites liked to this Site, or the Materials or information contained therein. If your use of the Materials or information from this Site results in the need for servicing, repair or correction of equipment or data, you assume all costs thereof.

7. Modifying or Terminating Motorsport Engineer Services
We are constantly changing and improving our Services. We may add or remove functions, features, or requirements, and we may suspend (to the extent allowed by applicable law) or stop part of our Services altogether. Accordingly, Motorsport Engineer may terminate your use of any Service for any reason. If your use of a paid Service is terminated, a refund may be available under our Refund Policy. 

None of Motorsport Engineer’s staff, its Content Providers and instructors, its contributors, sponsors, and other business partners, and their employees, contractors, or other agents shall have any liability to you for any such action.

8. Applicable Law
The Terms of Use are governed by the laws of the European Union and Spain. Failure to enforce strict performance of the Terms of Use of Use shall not be construed as a waiver of any provision or right. Motorsport Engineer may assign its rights and duties under the Terms of Use without notice to any party at any time.

9. Effective Date and Updates
The Terms are effective as of March 4, 2020 and are subject to change without notice by Motorsport Engineer at any time. Please check for changes regularly. Your use of this Site after such changes constitutes your agreement to such changes.

Acceptable Use Policy

Our mission is to provide worldwide online access to motorsport education. To ensure that people understand and follow common rules when participating in our online community and otherwise using our Services, please keep in mind the following:

You are prohibited from using our Services to share content that:

  • Contains illegal content or promotes illegal activities with the intent to commit such activities. 
  • Contains credible threats or organizes acts of real-world violence. 
  • Harrasses others. 
  • Violates intellectual property, privacy, or other rights. Always attribute materials used or quoted by you to the original copyright owner.

 

In regards to your Motorsport Engineer account, you also aren’t allowed to:

  • Do anything that violates local, state, national, or international law.
  • Share your password or let anyone besides yourself access your account.
  • Attempt to access any other user’s account.
  • Reproduce, transfer, sell, resell, or otherwise misuse any content from our Services.
  • Try to reverse engineer any portion of our Services.
  • Impersonate or misrepresent your affiliation with any person or entity.
  • Encourage or help anyone do any of the things on this list.

 

Without prior written consent from us, you also aren’t allowed to visit or use our Services for any form of content, data, or text scraping (including but not limited to screen scraping, web harvesting, or web data extracting) through manual, mechanical, or automated means including by the use of bots or other similar software.

 

 

Refund Policy

For details on our refund policy, please refer to the information below. Please note that our policies differ between offerings, and payment options may vary. Please also note that we treat violations of our Terms of Use seriously, and we have no obligation to offer refunds to users who violate these policies, even if their requests are made within the designated refund period. 

 

Self-Paced Courses: For self-paced courses, Motorsport Engineer will issue a complete refund within 15 days of payment, or until 15% of the course has been completed, whichever is earlier.

 

If you pre-enrol in a self-paced course, Motorsport Engineer will offer you a complete refund until 15 days after the course has launched or until you have completed 15% of the course, whichever is earlier.

 

Course Packages: For course packages, Motorsport Engineer will issue a complete refund within 15 days of payment, or until 15% of one self-paced course has been completed, whichever is earlier.

 

Career Accelerator Programs (Live Courses): For live courses, Motorsport Engineer offers a 7-day refund request window, minus administrative fees (€200) to cover software licencing costs. 

 

Motorsport Engineer does not offer scheduled payment cancellations or refunds for course payments made on a payment plan. Enrolling in a live course on a payment plan constitutes a commitment to pay the full program fee. If you wish to cancel your enrolment in a payment plan, you are still responsible for the full amount of the program fee, and no refunds will be issued for payments already made.
